By using this site the user has unconditionally accepted the terms and conditions of use as given hereunder and/or elsewhere in the site.
1. The user may carefully read all the information on products and services as provided in relevant sections and also in Frequently Asked Questions.
2. This site is owned by AllTimeGifts.com division of RA Ventures (here in after “AllTimeGifts.com”). No material from this site or any other web site owned, operated, controlled or licensed by AllTimeGifts.com and/or associates or sister concerns may be copied, reproduced, republished, transmitted, downloaded, uploaded or in any other manner for commercial use or otherwise without written permission of AllTimeGifts.com. Violation of this condition is a violation of copyright and other proprietary rights of AllTimeGifts.com and/or their associates or sister concerns or affiliates.
3. The product/services provided on this site are without warranties of any kind either expressed or implied and AllTimeGifts.com disclaims all or any of them to the fullest extent. AllTimeGifts.com does not warrant that the products/services offered will be error-free, or that the defects will be corrected, or that this site or the server that makes it available are or will be free of viruses or other harmful components. Any warranties or After Sale Services if any offered by the Manufacturers/Vendors on any product shall be serviced directly by such Manufacturer/Vendor and AllTimeGifts.com shall not be under any obligation to ensure compliance or handle complaints.
4. Under no circumstances whatsoever shall AllTimeGifts.com be liable for any loss of data, lost profits or any damages whatsoever including, without limiting, any indirect, special, incidental, consequential or other damages that result from the use of or inability to use the products/services offered in the site. Notwithstanding the foregoing, in no event shall AllTimeGifts.com be liable to the user for any or all damages, losses, and causes of action (including but not limited to, negligence) or otherwise exceeding the amount paid by the user to AllTimeGifts.com for that specific service/product.
5. Notwithstanding any or all of the Terms, Conditions & Disclaimers stated herein above and in FAQ or elsewhere in the site, any refund or payment by AllTimeGifts.com to the user or anyone else acting on his behalf for any reason whatsoever, voluntarily or on being claimed by any user shall not become a waiver of any or all of the Terms, Conditions and Disclaimers made and shall not become a precedent for similar future actions/claims or confer any rights on the claiment. AND further that all such refunds/payments if any when made shall be subject to 10% deduction on account of Bank charges and other processing overheads.
6. If the user has any question, doubts or confusion in regard to any of the terms & conditions set out herein he should seek clarifications from us through Email:support@alltimegifts.com and should wait for a written clarification before using the service.
Other Issues
Disputes:
All and any disputes related to AllTimeGifts.com service shall be subject to the jurisdiction of
Phagwara, Punjab (India) courts.
Payments:
All prices are in US Dollars. Payments will be accepted in US Dollars.
Accuracy of information and intent of making payment:
The customer promises that the information provided to AllTimeGifts.com will be true, current, correct and accurate including credit card numbers and addresses. The customer also agrees to pay all charges incurred by them and users of your account and credit cards or other payment mechanism at the prices in effect when such charges are incurred.
Non Availability:
If the ordered product is out of stock and AllTimeGifts.com is unable to deliver the gift, a complete refund will be made to the customer. We shall not be liable for any other charges, loss of profits, emotional stress or any other liability etc caused due to the non delivery and non availability.
Delivery Attempt:
Is when AllTimeGifts.com tries to deliver the gift, and is unable to do so due to either:
1. A wrong address or
2. No one being at home.
Late Delivery:
If the delivery is made after 9 days of the "preferred date" a 25% discount will be refunded to the customer. This is provided no delivery attempt was made by AllTimeGifts.com. In case a delivery attempt was made and could not be delivered due to either a wrong address or no one at home or uncontrolled circumstances like strikes and disturbances, no refund will be given.
No one at Home:
If AllTimeGifts.com attempts a delivery, and cannot do so as no one is at home, AllTimeGifts.com will leave a 'delivery note' at the address.
Perishable goods - The recipient will be able to collect the gift from the closest AllTimeGifts.com office that will be mentioned on the delivery note. The perishable goods will be held for 24 hours. Also, the perishable goods can be left with a neighbor provided we have received instructions from the customer on the order form in the comments section. No refunds or cancellations will be made for perishable goods.
Non-perishable goods - The gift will be returned to the AllTimeGifts.com office in
Phagwara. In the event of no one being at home, every genuine effort shall be made to a re-delivery. In the unlikely event the gift is unable to be delivered due to no one being at home we will return the goods to the AllTimeGifts.com office in
Phagwara. The customer will be informed. The goods will be held for 15 days at the office. No refunds will be given to the customer. The only exception will be if the value of the gift exceeds $40 (US Dollars forty), a US $ 40 cancellation charge will apply and the balance returned to the customer.
Delivery Period and Timing:
AllTimeGifts.com shall try to deliver the gift on the 'preferred date'. Please allow the minimum time required for delivery as specified in each category. Gift deliveries shall be made within three to seven working days in India provided the time specified for that category of gifts is not more. Delivery shall be made on the 'preferred day', or a day earlier or later if it coincides with a festival day or a national holiday. Delivery shall be made in the course of the day, and the customer agrees to refrain from requesting for deliveries at very early or late hours of the day. All attempts will be made to deliver at the specified time on the preferred date of delivery but AllTimeGifts.com will not be responsible if the gifts cannot be delivered at the specified time.
We DO NOT deliver on SUNDAYS and Public Holidays in India.
Warranties
Perishable Gifts - AllTimeGifts.com does not provide any warranties on the products it delivers.
Non-perishable Gifts - Warranties are provided by the suppliers of the gifts in certain items such as watches. The customer agrees that the customer service issues regarding the products (gifts) will be taken up with the manufacturer directly. AllTimeGifts.com will pass on any warranty cards if available to the recipient of the gift at the time of delivery.
THE USER OF AllTimeGifts.com IS PRESUMED TO HAVE READ ALL THE TERMS AND CONDITIONS HEREIN AND FAQ AND IS DEEMED TO HAVE AGREED, UNDERSTOOD AND ACCEPTED UNCONDITIONALLY ALL THE TERMS, CONDITIONS, PROCEDURES AND RISKS OF USING THE SERVICES AND CAN NOT AT ANY TIME CLAIM IGNORANCE OF ANY OR ALL OF THEM. ALL RELATIONSHIP OF ANY USER WHERESOEVER SITUATED IS GOVERNED BY AND IN ACCORDANCE WITH THE LAWS OF
PHAGWARA, PUNJAB, INDIA.
